Today's ExchangeWire Digest: 64% of Australian agencies will increase investment in podcasts. OpenAI files four motions to dismiss claims in NYT lawsuit. TikTok loses even more music
The latest IAB research into audio advertising in Australia reveals that nine out of 10 agencies are using audio advertising this year. The majority of agencies plan to increase investment in streaming audio (61%) and podcasts (64%) throughout the year. Brands that use digital audio ads cite brand building as their primary campaign goal, and few use the channel for sub-funnel activities. Audience attention and engagement was seen as the main driver of audio investment in the region. Meanwhile, data and targeting remained the main drivers for buying digital audio ads programmatically.
In the US, OpenAI has filed a motion to dismiss key elements of the lawsuit brought by the New York Times. The publisher had accused the AI company and its investor Microsoft of using the publisher's millions of articles to train AI models such as Chat GPT. The motion asks the court to dismiss four claims in the publisher's complaint in order to narrow the focus of the case. Lawyers for the AI giant argue that the New York Times should not be allowed to sue for copying practices that occurred more than three years ago and for violating the Digital Millennium Copyright Act.
As we look to the world, more music could be leaving TikTok following a dispute between the video giant and Universal Music. In early February, TikTok removed about 3 million songs by artists signed to music groups. Even more music is expected to disappear this weekend as publishing catalog deals end. The video industry giant has said that up to 30% of songs considered popular could be lost, but some industry experts believe that copyright splits could result in the loss of all music on the platform. We estimate that up to 80% of users may be muted.
