A North Texas woman was sentenced to 40 days in jail after pleading guilty to racist swearing at a group of Indian-American women two years ago. A now-viral video of the incident shows Plano resident Esmeralda Upton mocking the group’s accents, calling them “curry chicks,” and then punching them.
Upton pleaded guilty Friday to three counts of assault and one count of terroristic making threats, according to the Chandra Law Firm, which is representing the victims in the case. The charges and convictions also include hate crime provisions under Texas law, Chandra’s lawyers said in a statement.
According to his law firm, under a plea agreement with the county district attorney’s office, Upton will serve his time in the Collin County Jail on weekends starting July 19. However, the judge warned Upton that if he is ever late, his sentences will run consecutively.
Upton’s guilty plea stems from an incident on Aug. 24, 2022, when he accosted four Indian-American women in the parking lot of Sixty Vines restaurant in Plano.
In the two-and-a-half minute video, Upton can be heard saying: “I hate you f**king Indians. I don’t want you here.”
Anamika Chatterjee, one of the women confronted by Upton in the video, said in a statement to the court that she fears for her children’s safety since the incident and has not returned to Sixty Vines restaurant.
“I no longer feel safe, even when talking with friends in public,” Chatterjee said, addressing Upton directly. “You have impacted my ability to live a normal life and experience normal moments of enjoyment without fear or worry.”
A civil lawsuit accusing Upton of assault, battery, intentional infliction of emotional distress and defamation is still pending.
