A real estate agent has moved the Bombay High Court seeking a review of the cheating case involving former Mira-Bhayandar MLA Narendra Mehta. The petitioners allege that Mehta used his political influence to avoid litigation.
A bench of Justices Revati Mohite Dere and Manjusha Deshpande gave the state government two weeks to respond to the petition.
The petitioner, Mr. Jay Chandrapraksh Shukla, had initially worked with Raj Builders and Developers as the exclusive agent for the sale of properties on Godbundar Road and Mira Bhayander.Despite receiving a salary INRAt a cost of $2.49 billion, the builder was unable to develop the property as agreed.
In 2019, they agreed to transfer the ownership of the property to Shukla, but later refused to execute the sale deed. In January 2021, Shukla was allegedly threatened by Mehta to accept whatever money he was offered and part with his property. Mr. Mehta was planning to acquire the land through a company, 7-Eleven Constructions Private Limited, which is believed to be his front, the petitioner alleged.
“Despite Mr. Mehta being well aware of the petitioners' interests and rights, he chose to have the land delivered by bulldozer in the name of his company, thereby deliberately creating a dispute over the property.” the petition alleges. Petitioner further alleged that Mr. Mehta conspired with others to commit fraud by using intimidation, influence and other means.
An FIR has been filed against Mehta and 7-Eleven Constructions under the IPC and the Maharashtra Protection of Interests of Depositors Act, 2021. The petitioner said that despite the existence of evidence, Mehta was not charged with any offense in the charge sheet due to political pressure on the police. Shukla said that despite requests for a reinvestigation, no additional charges have yet been filed.
