There are two types of marriage licenses:formal marriage license and declaration and Registration of informal marriages (common law). The basic requirements for both types of marriage are the same.
- Both parties must attend together in person or via video conference. **Video conferencing is available for official marriage license applicants only**
- Both parties must be at least 18 years old.
- A valid government-issued photo ID is required. Your name will appear on your marriage license exactly as it appears on your ID. The County Clerk's Office cannot change the name or spelling of a name on an ID. Acceptable forms of valid identification include:
- You must know your social security number.
- Affidavit of age and identification if applying only by video conference
- No blood test required.
Effective January 1, 2019, if neither applicant can prove Texas residency, a $100 out-of-state applicant fee will be assessed. Acceptable forms of evidence are:
- driver's license
- state ID
- handgun license
- Vehicle registration
- Property tax return or homestead exemption
- voter registration card
- Military Order Reflecting Texas as Home of Records
- income tax
- Pay stub or proof of employment on company letterhead
- Receiving benefits from national institutions
- Utility bill (12 months history)

formal marriage
An official marriage license can be obtained in any county in Texas and you can get married anywhere. If your marriage will take place outside of Texas, check with the appropriate state office, consulate, or embassy to determine the marriage requirements for that state or country.

There is a 72-hour waiting period from the time the driver's license is issued until the wedding can take place. The 72-hour waiting period can be waived by meeting one of three criteria:

If the applicant is a member of the United States Armed Forces and is on active duty, no waiting period applies. Wedding guests must present military identification.

If the applicant obtains a 72-hour waiver signed by a district judge, the waiting period does not apply. The waiver must be presented and retained by the person performing the ceremony.

If the applicant has a valid Twogether in Texas certificate or premarital counseling certificate from a known counselor, the waiting period does not apply. The certificate must be printed and presented to the person issuing the marriage license and the person performing the ceremony.

The marriage must take place within 90 days from the date of issue. There are no exceptions.

If you divorce, unless waived, there is a 30-day waiting period after the divorce is finalized before you can remarry. If the 30-day waiting period is waived, you must provide a certified copy at the time of license purchase.

- Once the ceremony has taken place and your license is complete, you can hand-deliver your license to one of our eight locations to expedite the recording process. If you receive it from one of the people listed on the license, a recording process will take place while you wait. If not, the recorded license must be mailed to the newlyweds.

You can fill out and save your marriage license application online. However, applicants must be in person to sign and purchase a marriage license. Please note: Additional information is required from each applicant when a marriage license is issued. Minors Obtain a Marriage License
Effective September 1, 2017, if either applicant is under 18 years of age, a court order is required under Texas Family Code Chapter 31 to remove the applicant's minority disability for general purposes.
